Privacy Policy

How MonkeysCode collects, uses, stores, and protects your information.

Effective Date: July 26, 2026Last Updated: November 4, 2026

Data Controller: Colibricode Inc., Denver, Colorado, United States

1. Introduction & Scope

This Privacy Policy explains how Colibricode Inc. (“Colibricode,” “we,” “us,” or “our”), a Colorado corporation with its principal place of business in Denver, Colorado, collects, uses, discloses, and protects information in connection with MonkeysCode — our agentic coding IDE and AI service — including:

  • The MonkeysCode website and marketing pages (monkeyscode.com)
  • The MonkeysCode IDE, Terminal, and Troop applications
  • Capuchin, MonkeysCode's own AI model, and any commercial AI models (Claude, Gemini, ChatGPT, or others) accessed through MonkeysCode
  • The MonkeysCode account dashboard, billing portal, and related web applications
  • Any other service that links to this Policy (collectively, the “Service”)

This Policy applies to all users of the Service worldwide, and includes disclosures specifically required under the EU/UK General Data Protection Regulation (“GDPR”), the California Consumer Privacy Act as amended by the California Privacy Rights Act (“CCPA/CPRA”), the Colorado Privacy Act (“CPA”), and other applicable U.S. state privacy laws.

2. Who We Are

Data Controller: Colibricode Inc. (operating MonkeysCode)

Address: Denver, Colorado, USA

Privacy contact: privacy@monkeyscode.com

3. Information We Collect

3.1 Information you provide directly

  • Account information: name, email address, password (hashed), organization name, billing address.
  • Payment information: processed by our payment processor, Stripe; Colibricode does not store full card numbers.
  • Support communications: anything you send us via email, chat, or support tickets.
  • Content you submit for AI processing: prompts, code, file context, and instructions you send to any model through MonkeysCode (see §3.3).
  • Marketplace publisher verification: if you choose to publish publicly on the MonkeysCode Marketplace, identity details and documents you upload to verify who you are (see §3.4).

3.2 Information collected automatically

  • Usage and telemetry data: feature usage, session duration, crash reports, performance metrics, agent-run metadata.
  • Device and log data: IP address, browser type, operating system, device identifiers, timestamps, referring URLs.
  • Cookies and similar technologies: see §12.

3.3 Code, prompts, and content submitted to AI models

How your content is handled depends on which model you use:

Model pathWhat happens to your content
Capuchin (managed)Processed on Colibricode's GCP infrastructure. Not used to train or improve Capuchin unless you explicitly opt in.
BYOK (your own API key)Depending on the client and integration, sent directly to the provider or through Colibricode's proxy using your credentials. On proxy-based paths, Colibricode receives and processes the submitted content to forward the request, including format conversion for the CLI's Anthropic integration. Both this Policy and the provider's terms apply to proxy-based processing.
Managed third-party accessColibricode acts as an intermediary. Both this Policy and the provider's terms apply.
Local modelsInference runs on your device when configured to use a local model. This does not cover content you submit separately to managed models, cloud features, tools, or integrations.
Self-hosted / remote modelsInference requests are sent to the endpoint you configure. Separate managed models, cloud features, tools, or integrations may also transmit content when used.

Local indexing is distinct from model inference. When you use managed inference, the prompts, code, and selected context submitted for that request are processed remotely. Using your own provider key does not by itself mean the request bypasses Colibricode's infrastructure.

3.4 Marketplace publisher identity verification

Before a publisher's first public release on the MonkeysCode Marketplace, a MonkeysCode reviewer confirms who the publisher is. This is optional: you only provide it if you want to publish publicly, and you can register plugins and upload releases without it.

  • What we collect from a person: your legal name, date of birth, home address, phone number, the country that issued your ID, the type of ID, and only the last 4 characters of its number (never the full number). Documents: a government-issued photo ID.
  • What we collect from an organization: its registered name, registration number, country of registration, registered address, phone number and (optionally) website; the name and role of the person submitting for it. Documents: a registration document showing the registration number, and the photo ID of the person submitting.
  • Optional documents: for example a photo of you holding your ID, proof of address, or proof that you can act for a company, only if you choose to add them or a reviewer asks for them.
  • Why: to prevent impersonation, fraud, and malware distribution, and to hold publishers accountable for what they release to other users.
  • How it is checked: a person compares the documents. We do not use face recognition, and we do not create or keep biometric templates or identifiers from your photos.
  • Minimization: location and other metadata are removed from photos when you upload them. Documents are stored encrypted in a private storage account and are never shown on the Marketplace. A reviewer sees them only through a link that expires after 60 seconds, and the person who submitted them can never review them.
  • What stays visible: the “Verified publisher” badge and the publisher name. Your legal name, address, phone, date of birth, ID details, registration number, and documents are not published.
  • Retention: documents are deleted automatically 120 days after you upload them, whatever the outcome. We keep the decision, the reviewer's note, the dates, and a SHA-256 fingerprint of each document so the decision can be audited later; a fingerprint cannot be used to rebuild the document. The details you type (listed above) are kept as our publisher register while you publish on the Marketplace and for 2 years after your last verification ends, so that we can act on abuse reports and legal requests about what was published. A verification lasts two years.
  • Your choices: you can ask us to delete your documents sooner at privacy@monkeyscode.com. If you do this before a decision, the verification cannot be completed. Your other rights are described in §11.

4. How We Use Information

  • Provide, operate, and maintain the Service, including routing requests to the model you select
  • Process payments and manage subscriptions
  • Provide customer support
  • Monitor, secure, and troubleshoot the Service, including detecting fraud, abuse, and violations of our Terms
  • Administer free trials and promotional programs
  • Improve Capuchin and the Service, only from opt-in signals (see §6)
  • Comply with legal obligations, respond to lawful requests, and enforce our agreements
  • Communicate with you about the Service, including security and billing notices

6. AI Model Training & Opt-In Data Use

Colibricode's approach to improving Capuchin is opt-in only:

  • Free, Pro, Pro+, Ultra, and Team plan users are asked to explicitly opt in before any usage data is used to improve Capuchin. The default is off.
  • Enterprise, self-hosted, and air-gapped customers are never included.
  • Where opt-in is given, we prioritize derived signals over raw source code and apply reasonable measures to minimize sensitive content.
  • We do not use content submitted to third-party models to train any Colibricode model.

7. How We Share Information

We do not sell your personal information, and we do not use your code or prompts for cross-context behavioral advertising.

8. International Data Transfers

Colibricode is based in the United States, and Capuchin is served from U.S.-based cloud infrastructure. If you are located in the EEA, UK, or Switzerland, your information may be transferred to the United States. Where required, we rely on the EU Standard Contractual Clauses (and the UK International Data Transfer Addendum) to safeguard such transfers.

9. Data Retention

  • Account data: for the life of your account plus 90 days after closure, unless required longer by law.
  • Billing records: as required by tax and accounting law (typically 7 years).
  • Prompts/code sent to Capuchin: retained as needed to operate the Service, then deleted or anonymized.
  • Signed agent-run records: retained as configured by your plan.
  • Marketplace publisher verification documents: deleted automatically 120 days after upload.
  • Marketplace verification decisions: the decision, reviewer note, dates, and document fingerprints, for as long as the publisher account exists plus 3 years, for audit, fraud, and dispute purposes.
  • Marketplace publisher register: the verification details you type (see §3.4), while you publish on the Marketplace and for 2 years after your last verification ends.
  • Withdrawn Marketplace packages: only the copies and evidence needed for moderation, security investigations, legal obligations, and disputes, for up to 3 years after withdrawal.

Enterprise and self-hosted customers may configure shorter or custom retention periods contractually.

10. Security

  • Network protection: Google Cloud Armor (WAF, DDoS protection) at the network edge.
  • Encryption: data encrypted in transit (TLS) and at rest.
  • Access controls: least-privilege IAM for all internal systems; provider API credentials encrypted at rest.
  • Audit logging: infrastructure and administrative actions are logged.
  • Sandboxed execution: AI agent actions run in isolated sandboxes.

No system is perfectly secure. If we become aware of a data breach, we will notify you and applicable regulators as required by law. See our Security page for full detail.
